Acceptance of This Agreement
Your access to and use of eventpoint.app is subject exclusively to these Terms of Use and the Privacy Policy below (together, the "Agreement"). By accessing, browsing, registering for, or otherwise using the Platform, you confirm that you accept this Agreement and agree to comply with it. You must not use the Platform for any purpose that is unlawful or prohibited by this Agreement. If you do not accept this Agreement, you must immediately stop using the Platform.
Definitions
"Content" means any text, images, event listings, descriptions, comments, reviews, messages or other material made available on the Platform. "User Content" means Content you submit. "Organiser" means a User who creates, lists, or manages an event or sells tickets through the Platform. "Attendee" means a User who discovers, joins, or purchases tickets to an event. "Event" means an event listed on the Platform, whether created by an Organiser or aggregated from a third-party source.
Eligibility & Accounts
You must be at least 16 years old (or the minimum age required to consent to the processing of personal data in your country) to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current and complete information and to keep it up to date. We may suspend or close accounts that are inactive, that we reasonably believe have been used in breach of this Agreement, or where required by law.
Nature of the Platform
Event Point is a discovery and listing platform that helps people find, create, and share events. We act as an intermediary and venue for Organisers and Attendees. Except where we expressly state otherwise, we are not the organiser, promoter, owner, or host of any Event listed on the Platform, we do not control and are not responsible for Events, and we do not guarantee that any Event will take place, be accurate, be safe, or meet your expectations. Any contract for attendance at, or tickets to, an Event is concluded directly between you and the relevant Organiser.
User Content & Conduct
You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and display), publish and distribute that User Content for the purposes of operating, promoting and improving the Platform. You represent that you have all rights necessary to grant this licence and that your User Content does not infringe the rights of any third party.
You agree not to: post Content that is unlawful, defamatory, fraudulent, obscene, hateful, or infringing; list fake, misleading, or illegal Events; impersonate any person or entity; upload viruses or malicious code; scrape or harvest data except as expressly permitted; attempt to gain unauthorised access to the Platform or its systems; or use the Platform to send spam or unsolicited communications. We may remove any Content and suspend any account that we reasonably consider to breach this Agreement, without notice.
Events & Organisers
Organisers are solely responsible for their Events, including the accuracy of listings, obtaining all necessary permits and licences, complying with all applicable laws (including health, safety and consumer-protection laws), and the conduct and outcome of the Event. Organisers warrant that they are entitled to list and run their Events and to sell any tickets offered. Event Point does not verify, endorse, or assume responsibility for any Event or Organiser. Any dispute relating to an Event is between the Attendee and the Organiser.
Tickets & Payments
Where the Platform supports ticket sales, payments are processed by our third-party payment provider (Stripe) and are subject to the provider's terms. The Organiser is the seller and merchant of record for any tickets and is solely responsible for the supply of the Event, for issuing tickets, for setting prices and taxes, and for handling refunds, cancellations, and chargebacks in accordance with applicable consumer law. Service or processing fees, where charged, will be shown before you complete a purchase and are non-refundable except where required by law. Event Point is not a party to the sale of tickets and accepts no liability for the Event or for an Organiser's failure to honour a ticket, save where required by law.
Third-Party Content & Links
The Platform may display Event information aggregated from publicly available third-party sources and may include links to third-party websites. Such Content and links are provided for convenience and do not constitute an endorsement. We are not responsible for the accuracy, availability, or content of any third-party source or website. If you believe aggregated Content infringes your rights, contact us at info@eventpoint.app and we will review it.
Intellectual Property
The Intellectual Property Rights in the Platform and in the materials on it (excluding User Content and third-party Content) belong to BASEPOINT GROUP s.r.o. or its licensors. The "Event Point" name and logo are trademarks of BASEPOINT GROUP s.r.o. and may not be used without our prior written consent. Except to the extent strictly necessary to access and use the Platform, you may not copy, distribute, publish, licence, or create derivative works from the Platform or its materials without our consent.
Disclaimers
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, whether express or implied, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, security, and accuracy, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect or consequential loss or damage (including loss of business, opportunity, data, or profits) arising out of or in connection with your use of the Platform, any Event, or any transaction with an Organiser. Nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded or limited under applicable Czech or EU law. Where our liability cannot be excluded but can be limited, it is limited to the amount you paid to us (if any) in the twelve months preceding the relevant claim.
Indemnity
You agree to indemnify and hold BASEPOINT GROUP s.r.o. and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses arising out of any breach by you of this Agreement, your User Content, your Events, or your use of the Platform.
Suspension & Termination
You may stop using the Platform and close your account at any time. We may suspend or terminate your access to the Platform, in whole or in part, with or without notice, if you breach this Agreement or where we are required to do so by law. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
Changes to the Platform & this Agreement
We may change, suspend, or discontinue any part of the Platform at any time. We may also update this Agreement from time to time; the "Last updated" date above indicates when it was last revised. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Agreement. If a change materially reduces your rights, we will take reasonable steps to notify you.
Governing Law & Jurisdiction
This Agreement and all matters arising from it are governed by the laws of the Czech Republic. The courts of the Czech Republic shall have jurisdiction over any dispute arising in connection with this Agreement. If you are a consumer, you benefit from any mandatory provisions of the law of the country in which you reside, and nothing in this Agreement affects your rights as a consumer to rely on those mandatory provisions.
General
If any provision of this Agreement is held to be void or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver of that right. Headings are for convenience only. This Agreement constitutes the entire agreement between you and us relating to its subject matter and supersedes any prior agreements.
